NEXT FITNESS CHALLENGE (NFC) – Competitor Entry

Step onto the competition floor at World Sports South Africa and take on the NEXT Fitness Challenge. NFC is a fully timed and judged functional fitness race combining running, strength stations and conditioning into one continuous performance test.

This is a structured competitive environment designed for everyday athletes, serious fitness enthusiasts and teams. Divisions are scaled to ensure fair competition across ability levels.

2. ACKNOWLEDGEMENT OF NATURE OF EVENT AND RISKS
I acknowledge that the NEXT Fitness Challenge (NFC) is a high-intensity physical
competition forming part of World Sports South Africa and involves activities including, but
not limited to:
Running, lifting, carrying, pushing, pulling, climbing, and functional fitness exercises
Timed heats, shared lanes, and interaction with other participants
Use of specialised fitness equipment and temporary event structures
I understand that participation exposes me to inherent and significant risks, including:
Serious bodily injury, permanent disability, or death
Muscle strain, joint injury, fractures, dehydration, cardiac events or exhaustion
Slips, falls, collisions with other participants, equipment or structures
Risks arising from surface conditions, crowd density, or environmental factors
Risks arising from the actions, negligence, or misconduct of other participants
I confirm that I fully understand these risks and voluntarily choose to participate.

3. MEDICAL FITNESS AND RESPONSIBILITY
I warrant that:
I am physically fit and in good health to participate in strenuous activity
I have not been advised against such activity by a medical professional
I do not su􀆯er from any condition that may endanger myself or others
I accept full responsibility for monitoring my physical condition during the event and will
withdraw if I experience distress, pain, or abnormal symptoms.

4. ASSUMPTION OF RISK
I voluntarily assume full responsibility for all risks, known and unknown, even if arising from
negligence, and accept full liability for any injury, loss, or damage sustained during or as a
result of my participation.

5. INDEMNITY AND WAIVER OF LIABILITY
To the fullest extent permitted by the laws of the Republic of South Africa, I hereby
irrevocably:
Waive any and all claims I may have
Release and discharge
Indemnify and hold harmless
the following parties:
NEXT Events & Festivals (Pty) Ltd
World Sports South Africa
All event organizers, directors, employees, agents, contractors, volunteers
All sponsors, partners, exhibitors, and service providers
DHL Stadium and all associated entities
from any and all liability, claims, demands, actions, damages, losses, costs, or expenses of
any nature whatsoever, including legal costs, arising out of or in connection with:
My participation in the event
My presence at the venue
Use or misuse of equipment or facilities
The conduct of other participants
This applies whether caused by negligence or otherwise.

6. LIMITATION OF LIABILITY
I agree that none of the above parties shall be liable for:
Any injury, illness, disability, or death
Loss, theft, or damage to personal property
Any indirect, incidental, or consequential damages

7. EVENT-SPECIFIC CONDITIONS
I acknowledge and agree that:
Participation takes place in timed heats with multiple participants sharing lanes
Physical contact, congestion, and competitive pressure are inherent to the event
Equipment may vary in condition and requires responsible use
Instructions from event o􀆯icials must be followed at all times
Failure to comply may result in disqualification or removal without refund.

8. CONSENT TO MEDICAL TREATMENT
I consent to receive emergency medical treatment deemed necessary by event sta􀆯 or
medical personnel.
I acknowledge that:
Any medical treatment is at my own risk and cost
The organizers are not liable for any medical expenses incurred

9. PERSONAL PROPERTY
I accept full responsibility for my personal belongings and acknowledge that the organisers
are not liable for any loss, theft, or damage.

10. MEDIA RELEASE
I grant the organizers full and unrestricted rights to:
Photograph, film, and record my participation
Use such content for promotional, commercial, and marketing purposes
in perpetuity and without compensation.

11. DATA PROTECTION (POPIA COMPLIANCE)
I consent to the collection, processing, and storage of my personal information for:
Event administration and safety
Communication regarding the event and future events
Operational and marketing purposes
All information will be handled in accordance with applicable South African data protection
legislation.

12. NO REFUNDS AND EVENT TERMS
I acknowledge that:
All entries are non-refundable
Participation is subject to the event’s Terms and Conditions
The organizers reserve the right to modify event format, scheduling, or structure if required

13. SEVERABILITY
If any provision of this agreement is found to be invalid or unenforceable, the remaining
provisions shall remain valid and enforceable.

14. GOVERNING LAW
This agreement shall be governed by and interpreted in accordance with the laws of the
Republic of South Africa.

15. DECLARATION AND CONSENT
I confirm that:

I understand that I am giving up substantial legal rights
I sign this document freely and voluntarily without inducement

COMP

    1. Every person entering the event, even children and babies, requires their own valid ticket, either electronically on their phone or a printed ticket.

    2. Only tickets that match the indicated age of the ticket holder (i.e. Adult, Pensioner, Under 18, Child, etc.) will be admitted to the event.

        1. The organiser reserves the right to cancel any ticket that is being abused in this regard.

    3. Any person that does not meet the age restriction of the event or their particular ticket will be denied entry and have their ticket cancelled without any refund.

Cancellation of your Booking and/or Ticket(s)

    1. In terms of the Consumer Protection Act you have the right to cancel your advance booking and ticket(s) prior to the event, subject to a reasonable penalty and/or handling fee.

        1. More than 30 days before the event, there will be no penalty, but the handling fee will amount to 10% of the original purchase price of your ticket(s);

        2. Between 30 and 7 days before the event, the penalty and handling fee will amount to 50% of the original purchase price of your ticket(s); and

        3. 7 days or less before the event, the penalty and handling fee will amount to 100% of the original purchase price of your ticket(s);

    2. You will be refunded the original purchase price of your ticket(s), less the penalty and handling fee set out above within 21 days of cancellation.

    3. Subject to the payment method used to pay for your ticket(s) you may be required to furnish the organiser with additional information, such as your bank details, to obtain your refund.

    1. Should the event be cancelled due to any reason that could reasonably be within the control of the organiser, you will be refunded the full purchase price of your ticket(s).

    2. The refund will be affected at the discretion of the organiser, but in any event within three months of cancellation of the event.

Prohibition of Dangerous Conduct and/or Materials

    1. Any person that is intoxicated or in the sole and absolute discretion of the organiser in any way endangers other attendees at the event, may be denied entry or removed from the event (as the case may be) without any refund.

    2. Weapons, other dangerous materials and illegal drugs will not be permitted into the event.

    3. Any person bearing any of the items may be denied entry or removed from the event (as the case may be) without any refund.

    You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

NEXT Events & Festivals – Ticket Terms of Service

By purchasing a ticket, entering a venue, or attending any NEXT Events & Festivals event, you agree to these Terms of Service and the official NEXT Events & Festivals Terms and Conditions. If you do not agree, do not continue with your purchase.

All tickets are issued and managed by NEXT Events (Pty) Ltd for official NEXT Events & Festivals. Each ticket is valid only for the event, date, and venue confirmed at the time of purchase, unless reallocated by the Organizer.

Entry is subject to venue capacity, safety procedures, and compliance with event rules. The Organiser reserves the right to deny or revoke entry without compensation in cases of misconduct, intoxication, or failure to follow instructions.

All ticket sales are final. Once confirmed, tickets are non-refundable to the fullest extent permitted by law.

If an event is postponed, rescheduled, or cancelled, your ticket will remain valid for the new date or may, at the Organizer's discretion, be transferred to another NEXT event of your choice within the same calendar cycle.

In exceptional cases where an event cannot proceed, the Organizer may, at its discretion, offer a credit toward a future NEXT event.

The Organizer may reschedule, relocate, or alter the format of any event for operational, safety, legal, or commercial reasons, or due to circumstances beyond its control. Such adjustments do not entitle ticket holders to refunds.

All event programming, layouts, performers, and advertised attractions are subject to change without prior notice.

Attendees must follow the instructions of staff, security personnel, and event signage. The Organizer reserves the right to remove anyone from the premises for intoxication, harassment, unsafe behavior, vandalism, or failure to comply with safety or health protocols.

No unauthorized marketing, flyering, or sales activity is permitted on the venue grounds. No camping or overnight stays are allowed unless specifically authorized in writing.

Attendance is at your own risk. NEXT Events & Festivals, its employees, contractors, and partners are not liable for any loss, theft, injury, illness, or property damage arising during the event, except in cases of proven gross negligence.

The Organizer accepts no responsibility for indirect or consequential losses, including loss of income or opportunity.

Ticket holders are responsible for their own safety and belongings at all times. The Organizer is not responsible for lost or stolen items.

By attending, you consent to photography and filming by the Organizer for use in event coverage, marketing, and future promotions without charge.

Personal information collected during ticket purchases or event participation will be used solely for event communication and operations in line with the Protection of Personal Information Act (POPIA). Data will never be sold or shared with unrelated third parties.

The Organizer is not liable for delays, postponements, or cancellations caused by events beyond its control, including extreme weather, natural disasters, pandemics, strikes, venue restrictions, or government actions. In such cases, tickets will automatically transfer to the rescheduled event or may be used for another NEXT event within the same calendar cycle.

These Terms are governed by the laws of the Republic of South Africa. Any dispute will first be addressed through good-faith discussions, then mediation in Cape Town or Johannesburg. If mediation fails, either party may proceed in the High Court of South Africa.
